Using evidence of citizenship/national status from existing case files ............... page 37

  • Question 1:  If the county case record shows that satisfactory evidence of citizenship/identity has been verified for another program and Case Comments indicate the nature of the evidence viewed (i.e., "original New York State birth certificate viewed for John Doe"), must it be viewed again for Medi-Cal?  Do we have to make a copy of the viewed evidence and file it in the Medi-Cal case folder?      
  • Answer 1:  The original evidence need not be viewed again if the record shows that the evidence originally viewed meets the requirements of ACWDL 07-12 (see PP 20, 23, and 37 for information on reviewing case files from other programs).  However, a copy of this evidence must be available as part of the Medi-Cal-only case record.  MEDS must be updated to capture this citizenship/identity documentation unless the information is already included in MEDS.
  • Question 2: (posted 08/25/08): Are counties required to enter case comments stating that an ex-parte review has been conducted for citizenship and identity?
  • Answer 2: (posted 08/25/08): Counties are required to review existing case files for acceptable evidence of citizenship and identity as explained in ACWDL 07-12. Counties should record in the case file that the file was reviewed for acceptable evidence along with a summary of the outcome of that review. 
  • Answer 2: (posted 12/22/08): Additionally, If the case file does not show that an ex-parte review was conducted, it could be considered an error resulting in a negative case finding as the county is not complying with the requirements of ACWDL 07-12.
