보호된 데이터에 대한 액세스 요청을 위한 신청 자료
미국 보건복지부(DHCS)는 연구 또는 공중 보건 목적의 보호 대상 데이터에 대한 표준화된 신청 절차를 마련하고 있습니다.
일반적으로 DHCS DRC는 연구자 또는 후원자가 판매하려는 제품이나 도구의 개발로 이어지는 연구는 지원하지 않습니다. 예를 들어, 제약 회사가 연구에 직간접적으로 자금을 지원하는 경우 DHCS DRC는 처방약의 영향을 평가하고자 하는 요청자의 데이터 요청을 거부합니다.
DHCS는 다양한 간격으로 건강 보험으로부터 보호 대상 건강 정보를 수신합니다. 요청하는 데이터의 유형에 따라 서비스 시작일로부터 6~18개월이 지난 후 DHCS에서 데이터가 완료된 것으로 간주되기까지 지연이 발생할 수 있습니다. 예를 들어, 입원 환자 진료 데이터는 일반적으로 외래 환자 진료 데이터보다 완료하는 데 시간이 더 오래 걸립니다.
DHCS 데이터는 현재 2004년 10월까지만 사용할 수 있습니다.
DHCS adheres to releasing minimally necessary datasets when fulfilling data requests in accordance with Federal Laws and California Laws, as well as CHHS agency data sharing guidelines.
특히 연방 사회보장법 1902조(a)(42 U.S.C. § 1396a(7)에 따라 DHCS는 Medi-Cal 프로그램 관리와 직접 관련된 목적 외에는 보호 대상 정보를 공개하지 못하도록 제한하고 있습니다.
Note: Section 1798.24 (t)(1) of the California Civil Code statute states that DHCS can only grant data requests for Principal Investigators conducting scientific research for a nonprofit educational institution or for a non-profit research institution: “To the University of California, a nonprofit educational institution, an established nonprofit research institution performing health or social services research.”

- A copy of the Committee for the Protection of Human Subjects (CPHS) approval and research protocol (Please note that CPHS application is reviewed by a separate State entity from DHCS. Annual renewal of CPHS approval is required for the renewal of DUA).

국무부 요청을 위한 DRC 공중 보건 신청서(CalHHS 데이터 공유 프레임워크):
Data sharing at CalHHS is governed by the CalHHS data exchange agreement and the associated business use case proposal process. The CalHHS Data Exchange Agreement is bifurcated into two parts—one master agreement, Interagency Data Exchange (IDEA) Guidebook, with general legal boilerplate language and subordinate “Business Use Case Proposals” containing the specific business case to document each data exchange under the master agreement. The Business Use Case Proposal includes information such as data type, intended use, etc. The master agreement, when coupled with the Business Use Case Proposal, forms the complete, standardized, legally-compliant data sharing agreement.
