상원 법안 3의 제정에 따라 캘리포니아 주 전체 최저임금은 1월 1일부터 모든 고용주에 대해 $16.50에서 $16.90으로 인상됩니다( 1, 2026). 캘리포니아의 최저 임금 인상으로 인해 특정 제공자 유형 및 절차 코드에 대한 2026년 재택 및 지역사회 기반 서비스 환급률도 인상됩니다. 다음은 ALW에 적용되는 2026년 인상된 최대 지급률 목록입니다.

원호 생활 면제 자격
The Assisted Living Waiver (ALW) is a Home and Community-Based Services (HCBS) waiver that was created by legislation that directed the California Department of Health Care Services (DHCS) to develop and implement the program to test the efficacy of assisted living as a Medi-Cal benefit. Additional information about this legislation can be found on the Social Security Administration website. The Centers for Medicare and Medicaid Services (CMS) approves waiver renewals in five-year increments, and expansion of the program into additional counties. Currently, the ALW is available in 15 counties and the current five-year waiver term is approved for March 1, 2024 – February 28, 2029.
ALW 참여자로서 서비스를 받으려면 개인이 다음 ALW 자격 기준을 충족해야 합니다:
- 만 21세 이상;
- 비용 부담 없이 전체 범위의 Medi-Cal 자격을 갖추세요;
- 요양 시설에서 거주하며 치료를 받고 있는 Medi-Cal 지원 거주자와 동등한 수준의 치료가 필요합니다;
- 요양 시설의 대안으로 원호 생활 환경에서 거주할 의향이 있는 경우;
- 원호 생활 시설 또는 공공 보조금 지원 주택에 안전하게 거주할 수 있어야 합니다;
- Willing to live in an assisted living setting located in one of the following counties providing ALW services: Alameda, Contra Costa, Fresno, Kern, Los Angeles, Orange, Riverside, Sacramento, San Bernardino, San Diego, San Francisco, San Joaquin, San Mateo, Santa Clara, and Sonoma counties.

- 지역사회에 거주하지만 시설에 입소할 위험이 있는 적격 노인 및 장애인에게 ALW 서비스를 활용하여 RCFE, ARF 또는 공공 보조금 지원 주택에 계속 거주하면서 안전하게 돌봄 요구를 충족할 수 있는 프로그램을 개발할 수 있는 옵션을 제공합니다.
ALW 불만 사항
ALW 참여자이고 ALW 시설, 케어 조정 기관(CCA) 또는 귀하가 받은 ALW 서비스에 불만이 있는 경우 다음과 같은 방법으로 ALW 불만 사항을 제기할 수 있습니다.
- Grievances regarding the quality or receipt of ALW services must be submitted to your CCA via email, mail, or telephone. Find your CCA’s contact information.
- CCA의 진료 조정에 관한 불만 사항은 다음 이메일을 통해 의료 서비스 부서에 제출해야 합니다: ALWGrievances@dhcs.ca.gov
- All other grievances not listed above must be submitted to the California Department of Social Services, which will direct your grievance to your local ombudsman. Grievances can be submitted via telephone at (844) LET-US-NO ((844) 538-8766), via email at letusno@dss.ca.gov, or online at the California Department of Social Services Community Care Licensing Division webpage.

- ALW Slot Expansion Amendment WY 1 (Effective October 1, 2024), CMS approved DHCS’ amendment to the ALW to increase the waiver capacity for waiver year 1 of the 2024-2029 ALW.
- ALW Slot Expansion Amendment WY 2-5 (Effective March 1, 2025), CMS approved DHCS’ amendment to the ALW to increase the waiver capacity for waiver years 2-5 of the 2024-2029 ALW.
- ALW 슬롯 확장 수정안 (Effective January 1, 2024), CMS approved DHCS’ amendment to the ALW to add 1,800 slots to year 5 of the 2019-2024 ALW.

승인된 긴급 수정 사항
- Approved Appendix K Southern California Wildfires (Effective January 7, 2025), in response to the Los Angeles and Ventura Counties Fire, which has burned over 70,000 acres, prompted evaluation orders and road closures, and continues to threaten structures, homes, and critical infrastructure. This amendment, temporarily expands the settings in which services can be provided and permits retainer payments for certain services. Additionally, the amendment authorizes a temporary suspension of the enrollment period and extension of the reenrollment period.. The listed flexibilities are authorized under this amendment apply to waiver participants impacted by the State of Emergency in Los Angeles and Ventura Counties.
DHCS obtained approval for flexibilities accepted under the federal 1135 waiver authority which will expire January 7, 2026, for Los Angeles and Ventura Counties. The following flexibilities are available immediately.
Permit evacuating facilities (such as ICF-DDs, SNFs) to be fully reimbursed for services rendered to affected beneficiaries in alternative physical settings, such as temporary shelters or other care facilities.
Permit some services to continue to be provided without a requirement for a new or renewed prior authorization.
Temporarily allow services to be provided in settings that have not been determined to meet the HCBS Settings Rule criteria.
Temporarily extend the timeframe to reinstate services and benefits to an individual who files a fair hearing request.

Current enrollment and waitlist information for the Assisted Living Waiver can be found on the enrollment dashboard, which is updated monthly. New applicants to the ALW should be aware the number of available slots is limited and there is a waitlist. Open waiver slots are release to Care Coordination Agencies on a regular basis. Please contact the Care Coordination Agency of your choice for the information.
