DHCS seeks preliminary approval of ADHC Settlement
The Department of Health Care Services (DHCS) and plaintiffs jointly filed a signed settlement agreement on December 1, 2011, with the U.S. District Court to resolve the Darling et al v. Douglas lawsuit challenging the elimination of the Adult Day Health Care (ADHC) benefit. The parties received preliminary approval of the settlement on December 13, 2011, and final approval from the court was granted on January 24, 2012. The agreement ends the ADHC benefit on February 29, 2012, and replaces it with a new program called Community-Based Adult Services (CBAS) on March 1, 2012. The new program will provide necessary medical and social services to individuals with intensive health care needs.
