Optional Provisions FAQs​​ 

1. What are optional provisions and how can they be identified?​​ 

The optional provisions are italicized and bracketed in the Memorandum of Understanding (MOU) Templates. The Parties can choose to add one or more of these optional provisions to the MOUs to increase collaboration and communications. The optional provisions are not required to be included within the MOU. If one party wants to use the optional provisions but the other party does not, they should work to find a solution that is mutually agreeable, with the understanding that these provisions are not required by the Department of Health Care Services (DHCS).​​ 

2. Can Managed Care Plans (MCPs) and Third-Party Entities add provisions to their MOUs?​​ 

Yes, MCPs and Third-Party Entities can agree to include additional provisions, including the optional provisions DHCS has provided (italicized and bracketed) in the MOU Templates, provided any additional provision does not conflict with the required MOU provisions. DHCS is supportive of the inclusion of optional provisions.​​
